Terms of Service

Welcome to Veld Wyser. These Terms of Service (“Terms”) govern your access to and use of the Veld Wyser platform, including any related software, services, and data analytics (collectively, the “Service”).

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

Veld Wyser provides a digital decision-support platform designed for livestock farmers and land managers. The Service includes, but is not limited to, vegetation analysis, biomass estimation, grazing capacity calculations (including LSU/ha), weather insights, and management recommendations based on satellite data, environmental data, and user-provided inputs.

The Service is continuously evolving, and we reserve the right to modify, suspend, or discontinue any part of the Service at any time.

To access certain features, you must create an account. You agree to provide accurate and complete information and to keep your account credentials secure. You are solely responsible for all activities under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that are used in a manner that may harm the Service or other users.

You agree not to:

• access or use the Service for unlawful purposes;
• interfere with or disrupt the integrity or performance of the Service;
• attempt to gain unauthorized access to systems or data;
• reverse engineer or attempt to extract source code or models;
• use automated systems (such as bots or scrapers) without permission.

You retain ownership of any data you upload or input into the Service. By providing such data, you grant Veld Wyser a non-exclusive, worldwide, royalty-free license to use, process, and analyze that data solely in order to deliver the Service to you.

Your farm data is confidential. We apply the following limits:

• farm-specific data (such as field boundaries, herd numbers, production figures, observations and labels) is used only to produce results for your own farm;
• labels and corrections you provide train only the model for your own farm, not models serving other customers;
• we use your data to improve shared models or develop new features only in aggregated or anonymised form, from which your farm cannot be identified;
• any use beyond this requires your prior, separately obtained consent, which you may withdraw at any time.

We never sell your farm data, nor do we share it with other users or third parties, except with the processors listed in our Privacy Policy or where required by law.

You represent and warrant that you have the right to use and share such data.

The Service uses models, algorithms, and artificial intelligence to generate outputs, including predictions, classifications, and recommendations.

These outputs:

• are probabilistic in nature;
• depend on the quality and availability of input data;
• may be incomplete, inaccurate, or outdated.

The Service is intended solely as a decision-support tool. It does not constitute professional agricultural, financial, or operational advice.

You acknowledge that all decisions regarding livestock, grazing, land management, and farm operations remain your sole responsibility.

To the fullest extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind.

Veld Wyser does not guarantee:

• the accuracy of grazing capacity estimates (e.g. LSU/ha);
• the accuracy of biomass or vegetation analysis;
• the reliability of weather or environmental data;
• any specific agricultural or financial outcomes.

Natural systems, including rangelands, are inherently variable and influenced by factors such as rainfall, soil conditions, and management practices. As such, outputs may vary significantly over time and location.

To the maximum extent permitted by law, Veld Wyser shall not be liable for any indirect, incidental, consequential, or special damages, including but not limited to:

• loss of profits or revenue;
• loss of livestock;
• reduced production;
• business interruption;
• or damages resulting from reliance on the Service.

In any case, Veld Wyser's total liability shall not exceed the amount paid by you for the Service in the twelve (12) months preceding the event giving rise to liability, or €0 where the Service is used free of charge.

We do not guarantee uninterrupted or error-free operation of the Service. Downtime may occur due to maintenance, updates, or external dependencies (such as data providers or infrastructure).

Where applicable, access to the Service requires a monthly subscription. The subscription starts with a 30-day free trial; the first payment is only collected at the end of that trial. Fees are billed monthly in advance.

Cancellation: you may cancel at any time from your account (Subscription page). Cancellation takes effect at the end of the current billing period; you keep access until then. There is no notice period and no minimum term. Fees already paid for the current period are not refunded, unless the law provides otherwise.

Right of withdrawal (consumers): if you are acting as a consumer, you have the right to withdraw from the agreement within 14 days of entering into it, without giving reasons. We will notify you of price changes at least one month in advance. If you do not agree, you may cancel before the change takes effect.

You may terminate your account at any time. We may suspend or terminate your access if you violate these Terms or if continued use poses a risk to the Service or other users.

All rights, title, and interest in the Service, including software, models, and content, remain the exclusive property of Veld Wyser. No rights are granted except as expressly stated.

We may update these Terms from time to time. Minor changes (such as clarifications or corrections) take effect immediately.

We will notify you by e-mail or in the app at least 30 days before any change that materially affects your rights takes effect. If you do not agree, you may cancel the subscription before the change takes effect; it will then not apply to you.

These Terms shall be governed by the laws of the Netherlands. Any disputes shall be submitted to the competent courts of that jurisdiction.
